End User License Agreement

1. Introduction

Before installing the Font(s), please carefully read this End User License Agreement (“EULA”, “Agreement”). The EULA is a Legal Agreement between You and the FontBase that lays out the terms and conditions for using the Font(s).

Font(s) is protected under applicable intellectual property laws, relevant international agreements enforceable in the User’s jurisdiction, and the provisions of this EULA which is legally binding for all parties accepting it. By paying or installing the Font(s), You confirm Your consent to all the terms stated herein.

Any violation of this EULA may lead to the legal consequences established by the laws of the country where the Font(s) provider (FontBase) is located as well as applicable international regulations.

If You do not accept the terms of this EULA, You must delete all copies of the Font(s) from every device under Your control.

All rights to the Font(s) and its accompanying documentation belong to FontBase or its respective licensors. FontBase is the lawful holder of the rights to distribute the Font(s) and to grant end-user Licenses under this EULA on its own behalf.

2. Terms and Definitions

“FontBase” - Senary Domain LLC (hereinafter - “FontBase”, “We”, “Our”).

“End User” – an individual who has reached the legal age of capacity in their country of jurisdiction, has lawfully purchased the Font(s) through the Platform, and agrees to use the Font(s) solely in accordance with the terms and conditions set forth in this EULA (hereinafter - “User”, “You”).

“Platform” - online resource available at https://fontba.se, as well as FontBase desktop App, operated by the FontBase, which enables the User to purchase the Font(s) and receive any associated services or functionalities.

“Font(s)” - a graphic work consisting of individual representations of characters, letters, numerals, punctuation marks, and other symbols, created in a unified stylistic design or otherwise arranged as a coherent typographic system.

“User’s Personal Data” - any information relating to an identified or identifiable individual that the User voluntarily submits when purchasing the Font(s) through the Platform, including but not limited to contact details, billing information, and any other data required to process the transaction and provide access to the purchased Font(s) (hereinafter “Personal Data”).

3. Subject of the Agreement

Upon payment in full, the FontBase hereby grants to You a non-exclusive, non-assignable, non-transferable, revocable License to use the Font(s) on a personal or work-assigned desktop or laptop computer for the purpose of creating static, non-editable output. Permitted desktop use includes, but is not limited to:

• a) creating static graphics, images, logos, layouts, and other visual materials using design or office Font(s) installed on the User’s computer;
• b) producing printed materials such as brochures, packaging, posters, books, magazines, and other physical media;
• c) generating non-editable digital documents, including PDF files, presentations, and visual assets, provided that such documents do not allow third parties to access, extract, or reuse the embedded Font(s);
• d) using the Font(s) for internal business materials, personal design work, and client projects, insofar as the output remains static and the Font(s) themselves are not distributed.

The Font(s) shall be directly installed on Your system upon activation of the License. The User shall have the right to use Font(s) for obtaining access to Font(s) on not more than one computer at any one time by receiving and installing such Font(s). There is no limit on the number of internet domains to be assigned to Your projects for the use of Licensed Font(s).

You will have no direct access to, or control over, the underlying digital files at any stage of the installation process. You are expressly forbidden from copying, transferring, extracting, altering, relocating, or otherwise removing the Font(s) from any directory or location on your computer in which it is installed. Any such action shall constitute a material breach of this Agreement.

You are not permitted to use Font(s) on websites, or embed Font(s) in applications, ebooks, or games. Any use of the Font(s) beyond standard desktop use — including but not limited to web embedding, mobile or desktop application embedding, server-based use, broadcast use, e-publishing, product creation, or any other form of distribution or integration — requires the User to obtain an appropriate extended License. To purchase the required License for such additional uses, the User must contact the FontBase directly.

4. Payments and refunds

The Font(s) License is provided on a paid, subscription basis and requires full advance payment. Access to the Font(s) will be granted only after the FontBase has successfully received and confirmed the corresponding payment.

By purchasing a subscription, You authorize the Company to automatically charge the applicable fees on a recurring monthly or annual basis, unless and until You cancel the subscription.

If You fail to cancel the subscription before the renewal date, any fees charged are non-refundable.

If an automatic payment cannot be processed due to an expired, invalid, or otherwise unusable payment method, Your access to the Font(s) will be suspended until valid payment is provided. The FontBase shall have no obligation to provide refunds, credits, or compensation for any suspension, failed payment, or failure to cancel the subscription in a timely manner. The FontBase shall not be liable for any loss, damages, or inconvenience resulting from such suspension or termination of access.

The User acknowledges and agrees that the FontBase is under no obligation to provide reminders, notifications, or any other form of alert regarding the expiration or renewal of the License.

The FontBase reserves the right to change the prices of Font(s) at any time and will provide notice of price changes Platform.

5. Restrictions

You are strictly prohibited from reselling, transferring, sublicensing, loaning, leasing, distributing, or otherwise assigning the License or granting any third party access to the Font(s), whether in whole or in part, whether for consideration or free of charge. Any such attempted transfer shall be null and void.

You are further prohibited from adding functionality to, altering, adapting, translating, converting, modifying, remastering, enhancing, editing, deconstructing, or creating derivative works or any products based on the Font(s) or any designs, structures, or data embodied in the Font(s). Any attempt to replicate, imitate, or reproduce the Font(s)’s features, design, or functionality is likewise strictly forbidden.

You must not disassemble, decompile, reverse engineer, decrypt, analyze, or attempt to derive, access, extract, or reconstruct any part of the Font(s)’s source data, outline structures, glyph designs, OpenType tables, hinting instructions, or internal file logic. You are also prohibited from bypassing, disabling, altering, or otherwise circumventing any technical protection mechanisms, embedding restrictions, licensing controls, or usage limitations incorporated into the Font(s).

Prohibited Uses (Non-Desktop Use) The following uses fall outside the scope of permitted desktop use and require the purchase of an appropriate extended License from the FontBase. The User is strictly prohibited from:

• a) using the Font(s) on websites, web applications, or in any form of web embedding (including WOFF/WOFF2 formats);
• b) embedding the Font(s) in mobile applications, desktop software, games, or any other distributable digital product;
• c) using the Font(s) for server-side rendering, automated content generation, SaaS services, or any environment where third parties may indirectly access or benefit from the Font(s);
• d) embedding the Font(s) in e-books, interactive PDFs, or any documents intended for mass distribution or editing;
• e) using the Font(s) in broadcasting, video production, streaming, or any audiovisual media intended for public display;
• f) creating merchandise or physical or digital products where the Font(s) themselves become part of the product in a reproducible or template-based form;
• g) distributing, sharing, sublicensing, selling, or otherwise making the Font(s) available to third parties in any form.

6. Collection, storage and use of User’s Personal Data

The FontBase may collect, process, and store certain User’s Personal Data and cookie information strictly for the purposes of providing access to the Font(s), issuing and managing the License, processing orders made through the Platform, generating invoices, ensuring compliance with this Agreement, and improving the functionality and security of the Platform.

Information on how and for how long the FontBase collects, processes, stores, and uses the User’s Personal Data is provided in the FontBase’s Privacy Policy. The User agrees that all processing of Personal Data is carried out in accordance with that Privacy Policy.

7. Intellectual Property Rights

All intellectual property rights in and to the Font(s), including but not limited to the font design, glyph shapes, outlines, metrics, kerning data, OpenType features, naming conventions, internal file structure, character sets, stylistic variations, and any associated documentation (collectively, the “Intellectual Property”), are and shall remain the sole and exclusive property of the FontBase or its respective licensors.

The Font(s) and all related content are protected under applicable domestic and international laws, including but not limited to copyright law, trademark law, industrial design law, database right law, and international treaties governing the protection of intellectual property.

The User acquires no ownership rights in the Font(s). All rights not expressly granted to the User under this Agreement are expressly reserved by the FontBase. This Agreement grants only a limited, non-exclusive License to use the Font(s) under the specific conditions and restrictions set forth herein; it does not constitute a sale, transfer, assignment, or conveyance of any intellectual property rights.

8. Terms of License validity

The License and access to the Font(s) shall be granted to the User for the duration corresponding to the subscription plan selected and duly paid for by the User, and shall automatically terminate upon the expiration of such subscription period unless renewed in accordance with this Agreement.

Any breach or attempted breach of Sections 5 (Restrictions), 7 (Intellectual Property Rights) shall constitute a material violation of this Agreement and may result in immediate suspension or termination of the License, without refund, and may further subject You to civil and criminal liability to the fullest extent permitted by applicable law. The FontBase reserves all rights and remedies, including the right to seek injunctive relief, damages, and legal fees arising from any unauthorized use, attempted misuse, or infringement of the Font(s).

9. Final provisions

The Agreement shall be deemed accepted by the User and comes into effect from the moment of License payment (if applicable) or starting installing.

The FontBase reserves the right, at its sole discretion, to restrict or revoke a User’s rights to use the Font(s) for any new projects, including in the event of termination of the FontBase’s relationship with its licensors and/or partners.

All provisions not expressly governed by this EULA will be interpreted and applied in accordance with the FontBase’s Terms of Service, which form an integral part of this Agreement. In the event of any inconsistency between this EULA and the FontBase’s Terms of Service, the provisions of this EULA shall prevail with respect to the licensing, use, and restrictions of the Font(s), unless expressly stated otherwise.
